If an employer who runs a hotel, motel, restaurant, jungle safari or other similar business has charged any service charge from the customer, such service charge amount shall be distributed to the workers as follows:-
(a) After the initiation of this regulation, an agreement has been reached between the employer organization and the more representative trade union association associated with the related business, according to the same. (b) If there is no agreement as per clause (a), the monthly amount raised for the service fee shall be considered as 100% and distributed as follows: (1) Seventy-one percent of the total amount shall be paid by Damasahi to workers employed in establishments, trainees employed in accordance with section 18 of the Act, or workers employed through labor suppliers. (2) Twenty-four percent of the total amount to the employer for breakage and operational leakage management,
(3) Two ten thousand five percent by the employers' association related to the hotel business and two ten thousand five percent by the more representative trade union association of the hotel sector.
